To All Teachers in Labrador re: Labrador Benefits Agreement

The new Labrador Benefits Agreement, which was ratified by all unions covered by this contract, was officially signed by all employee and employer representatives in late June, 2016.  Approval from Treasury Board was given during the summer for government payroll officials to apply the increases on a go-forward basis and to calculate and pay retroactive increases.

Pursuant to the Agreement, the Labrador Allowance is now payable for all teachers on maternity and/or parental leave. This has implications for teachers in receipt of maternity or parental Employment Insurance benefits for any period in which Labrador Benefits are now payable (i.e. retroactively or in the future). Monies received should be declared to Employment and Service Development Canada (ESDC). Overpayments of Employment Insurance benefits may occur, and members are encouraged to discuss this with Association staff in a timely fashion.

Teachers who were on maternity or parental leave from June 15, 2016 to present

Earnings while in receipt of Employment Insurance benefits have to be declared to ESDC. Such sums are allocated to a period of time based on when they were earned, not when they were received. This can affect the benefits payable to a teacher. As such, teachers who were on maternity or parental leave in the period since June 15, 2016, and who receive retroactive Labrador Benefits,  should declare such earnings to ESDC  even if their claim for maternity or parental benefits is now closed. Teachers contacting Service Canada about retroactive payments should ensure that they advise Service Canada that these are retroactive payments made as a result of changes to a negotiated agreement.

Teachers who are currently in receipt of EI maternity or parental benefits or who will receive them in the future
